Terms of Texting

Thank you for joining our texting program! We have a few key terms and conditions that apply to our sending any messages to you. You accept these terms when you agree to join our program, and they apply to all messages you receive from us unless and until your membership is ended.

Please be aware that we will not contact you with sales messages unless you request them, we will not use a prerecorded, machine-read message, and that you do not need to enter into any agreement as a condition of any purchase. We will send messages only to the telephone number that you provided. To ensure smooth and efficient operation of our messaging service, we may message you using an automated system that selects and dials numbers for receipt of text messages, and you authorize us to use that automated system for that purpose.

Messaging Terms & Conditions

You agree to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages (e.g. cart reminders) from Camp Bow Wow, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Msg & Data rates may apply.

Message frequency will vary. Camp Bow Wow reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. Camp Bow Wow also reserves the right to change the short code or phone number from which messages are sent and we will notify you when we do so.

Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. Camp Bow Wow, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages. You also agree to our Camp Bow Wow Terms of Use and Camp Bow Wow Privacy Policy.

We are able to deliver messages to the following mobile phone carriers: Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile. Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

Cancellation

Text the keyword STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode or phone number to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode or phone number you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that Camp Bow Wow and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from Camp Bow Wow through any other programs you have joined until you separately unsubscribe from those programs.

Florida Law:. For purposes of compliance with the Florida Telemarketing Act and the Florida Do Not Call Act, you agree that at the time we message you, we may assume that you are not a Florida resident or visitor unless, at the time of opt-in to the program, (1) any contact address you provided is located in Florida; (2) the area code for the phone number used to opt-into the program is a Florida area code; or (3) you have affirmatively advised us in writing that you are a Florida resident or visitor by sending notice to us at compliance@voxiechat.com. You agree that the requirements of the Florida Telemarketing Act and the Florida Do Not Call Act do not apply to you, and you shall not assert that you are a Florida resident or visitor, if you do not meet these criteria. Insofar as you are a Florida resident, you agree that mobile messages sent by us in direct response to mobile messages or requests from you (including but not limited to response to Keywords, opt-in, help or stop requests and shipping notifications) and shall not constitute a “telephonic sales call” or “commercial telephone solicitation phone call” for purposes of Florida Statutes Section 501 (including but not limited to sections 501.059 and 501.616), to the extent the law is otherwise relevant and applicable. In addition, you acknowledge and agree that your receipt of one or more text messages from us does not constitute any “injury” to you.

In the event that you are seeking to enforce any provision of the Florida Do Not Call or Telemarketing Acts in arbitration or small claims court, those laws shall apply to you only to the extent that you can provide two forms of evidence of domicile in Florida (e.g. driver’s license and utility bill) and documentary evidence that you received the messages while in Florida (e.g. call records and evidence of date of travel.) Your failure to produce such evidence in arbitration or small claims court may be deemed sufficient to rebut any presumption arising from the fact that a call or text was made to a Florida area code.

Class Action Waiver. YOU AND WE EACH AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, REPRESENTATIVE, MASS, OR CONSOLIDATED ACTION. If we believe that any claim you have filed in arbitration or in court is inconsistent with this limitation, then you agree that we may seek an order from a court determining whether your claim is within the scope of this class action waiver. If a court or arbitrator determines in an action between you and us that any part of this Class Action Waiver is unenforceable with respect to any claim, the arbitration agreement and Class Action Waiver will not apply to that claim, but they will still apply to any and all other claims that you or we may assert in that or any other action. If you opt out of the arbitration provision as specified above, this Class Action Waiver provision will not apply to you. Neither you, nor any other customer, can be a class representative, class member, or otherwise participate in a class, consolidated, or representative proceeding without having complied with the opt out requirements above.
