GENERAL OVERVIEW

This website or mobile application is one of several websites (the “Sites”) or mobile applications (the “Apps”) (collectively, the “Digital Services”) relating to and/or operated by Camp Bow Wow Franchising, Inc., Bow Wow Buddies Foundation, and any of their subsidiaries, affiliates and related companies (collectively, “Camp Bow Wow,” “us,” or “we”). The purpose of this Privacy Policy is to disclose to you what information we may collect, how we may collect it, with whom we may share it, and certain other matters related to such information, including the choices you have regarding our collection of information and our use and disclosure to other parties of information we may have collected from you. Terms not otherwise defined herein shall have the meaning ascribed to such terms in the Terms of Use applicable to the Digital Services. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information collected through our Digital Services.

For clarity, this Privacy Policy is applicable to information collected on those parts of the Digital Services which may be specific to a particular Franchisee. For example, when you go to make a dog boarding reservation at a specific Camp through the Digital Services this Privacy Policy will apply. This Privacy Policy does not apply to information collected from you when you are in person at a Camp location. Although we do provide the Franchisees with certain requirements regarding their business practices, and although certain data collected by Franchisees may be stored in the same customer database as other data collected by Camp Bow Wow, we cannot be held responsible for the data privacy and security practices of the Franchisees. Except as otherwise expressly set forth herein, this Privacy Policy does not govern the privacy and security practices of the Franchisees.

TYPES OF INFORMATION THAT MAY BE COLLECTED.

We and the Franchisees may collect personally-identifiable information and non-personally identifiable information when you use our Digital Services. Personally-identifiable information is information that can be used to identify you personally, either alone or in combination with other information, as well as any other information about you that can be attributed to you (“Personal Information”), and non-personally identifiable information cannot be used to identify a specific individual (together with the Personal Information, your “Information”). The Personal Information collected through our Digital Services is used to facilitate the transactions or information you may request on our Digital Services, and otherwise as described in this Privacy Policy. For example, we and/or our Franchisees, as applicable, may collect Personal Information on our Digital Services if you apply to become a Franchisee of a Camp Bow Wow location, reserve a spot for your dog in one of the Franchisee locations, inquire about our in-home services program and request an in-home consultation, make an online donation to the Bow Wow Buddies Foundation, request other information from us, subscribe to any of our online newsletters or email lists, enter a promotion on our Digital Services, request to be notified of special offers, or if you provide information through our Digital Services for any other reasons.

The Personal Information collected will vary depending on the nature of your interactions with our Digital Services and your specific requests, but it may include your name, email address, mailing address, phone number, or other information about you. If you are applying to become a Franchisee, we will need to collect significantly more detailed information from you, including financial information.

We and our Franchisees do not have access to financial account data in unencrypted form through our Digital Services. Rather, we use third party service providers to process all payment transactions for our Digital Services (whether the payment is by credit card, PayPal, or otherwise). Although these third-party processors will notify us if your payment has cleared, and may submit some of your Personal Information to us, they will not provide your credit card or other payment account information to us, and the third party will be solely responsible for any issues that may arise with your payment transaction.

If you provide Personal Information through our Digital Services, a profile will be created for you (and your dog, if applicable) in our database. If a profile is created, we may combine information we or our Franchisees receive from you or about you from various sources (including your transactions at our Franchisee camp locations, online or offline) in your profile. If you register for an account through our Digital Services, complete a doggie daycare reservation, or submit a request for services we or our Franchisees may collect your name, email address, phone number, and other information, and we and our Franchisees will have access to such Personal Information within our shared database.

If you apply for a job with Camp Bow Wow or one of the Franchisees, you may provide us or the Franchisee with Personal Information such as your name, address, email, phone number, background, criminal record, or other information. Any information provided in a job application will be managed in accordance with applicable laws and regulations.

HOW IS INFORMATION COLLECTED?

Information may be collected in several different ways through our Digital Services, including but not limited to those described below:

Information You Voluntarily Provide

In most cases we will only obtain Personal Information through our Digital Services if you voluntarily provide it to us, for example, if you create an account through our Digital Services or with one of our camp locations, subscribe to our emails, enter a promotion, or request information from us or a Franchisee. As well, we will collect your Personal Information from a Franchisee if that Franchisee adds your Personal Information to our Digital Services for storage, processing and later retrieval. We also automatically collect certain anonymous information, such as your browser settings and click-stream data, when you use our Digital Services. In some cases, we may combine Personal Information with anonymous data in order to create aggregate information about groups of individuals who use our Digital Services.

IP Addresses, Click-stream Data, App Usage and Device Information

We may collect IP addresses, click-stream data, App-usage details, length of session, and other information related to your use of our Digital Services for purposes of system administration, to improve the Digital Services, to report aggregate information to potential business partners or sponsors, and for other internal uses related to the Digital Services. An IP address is a number that is automatically assigned to your computer whenever you access the Internet. When you request pages from the Site, our computers log your IP address. Click-stream data is information collected when you visit different pages on our Digital Services. Click-stream data may include information such as the page served, the time, the source of the request, the type of browser, the preceding page view, and other non-personal information. App-usage details are automatically collected when you use an App, including how you interact with the App and which sections you visit. We may also collect information about your mobile device and internet connection, including the device’s unique identifier, operating system, and browser type. This data helps us analyze how visitors arrive at the Digital Services, what type of content is most popular, and other information about usage of our Digital Services.

Analytics Tools

We may use Google Analytics or similar tools or services to collect information such as how often users visit our Digital Services, what pages or features they visit when they do so, and what other sites they used prior to coming to our Digital Services. We use this analytics data to improve our Digital Services and tailor them to the needs of our users. Analytics providers may collect the IP address assigned to you on the date you visit our Digital Services, as well as your gender, age, interest categories, and other information to the extent it is available to the provider (based on your browser settings and otherwise). Google’s use of information collected by Google Analytics is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent certain analytics providers from recognizing you on return visits to our Sites by disabling cookies on your browser.

HOW DO WE USE THE INFORMATION WE COLLECT?

We internally use information about our visitors and customers to improve our service offerings, for our marketing and promotional efforts, to statistically analyze Digital Service usage, to improve our content and service offerings, and to customize the content and layout of the Digital Services. We believe these uses allow us to improve the Digital Services and provide better service to our customers. We or our Franchisees may use your email address and mailing address or phone number, to contact you regarding a reservation or inquiry you have made using our Digital Services, regarding issues with a transaction, satisfaction with the Digital Services and/or our products and services and to provide further information regarding additional events, products and/or services we believe would interest the customer. By creating an account on one of our Sites or Apps, you consent to receiving marketing emails and SMS messages from us. We may use the information you provide in text messages and SMS messages to you. You may opt out of these messages at any time, as provided below. By opting out of any such messages, you may still receive messages regarding any ongoing transactions or future reservations and transactions. We may use information in the file we maintain about a customer to resolve disputes and troubleshoot problems.

Except as otherwise set out in this Privacy Policy, we collect, process, store and use Personal Information only for the purpose for which it was first collected and, if applicable, as authorized by you, including the uses described in this Privacy Policy or other uses which you may later authorize. We take reasonable steps to ensure that Personal Information collected is relevant to its intended use, and is accurate, current and complete.

TO WHOM MAY THE INFORMATION BE DISCLOSED?

Information we collect may be disclosed to a variety of parties, depending upon the purpose for which the information was provided. In addition, in some circumstances you may provide Personal Information directly to third parties (e.g. third-party service providers who process payment transactions on our behalf), which may share certain information with us. In order to process your requests, we may also provide your Personal Information to service providers or other companies who work on our behalf in order, for example, to process a payment transaction you have initiated.

As well, we may provide your Personal Information to Franchisees in connection with your ongoing relationship with the Franchisee and the services provided to you by the Franchisee.

We may access or use your information, and we may share such information with our current or future affiliated and related companies, Franchisees, or carefully selected third parties, to provide you with offers, information, promotions or marketing communications in which we think you may be interested. You may opt-out of having your information shared or used for marketing purposes by following the instructions below under “What choices do I have about my information?”

In addition, in the event that we or our related entities or Franchisees go through a business transition, such as a merger, acquisition, liquidation or sale of all or a portion of their assets, Personal Information and other consumer data in our possession will, in most instances, be part of the assets transferred. However, your Personal Information will remain subject to the terms of this Privacy Policy (or any subsequent version of this Privacy Policy, under which it was collected) following the transfer.

OTHER COLLECTION, USE AND DISCLOSURE.

We may, without your consent or knowledge, collect, use and disclose your Information, any communications sent or received by you, and any other information that we may have about you to the extent we believe such collection, use or disclosure is permitted or required by law, regulation, rule or court order, including: pursuant to requests from governmental, regulatory or administrative agencies or law enforcement authorities; or to prevent, investigate, or identify persons or organizations potentially involved in, or take any action regarding, suspected fraud, violations of our Terms of Use, or any activity that appears to us to be illegal or we believe may expose us to legal liability. Additionally, we may disclose Information in situations that we believe to be emergencies involving potential threats to the physical safety or any person or property if we believe that your Information in any way relates to that threat.

WHAT CHOICES DO I HAVE ABOUT MY INFORMATION?

At any time, you may opt-out of having your Information provided to third parties for marketing purposes, and opt-out of other communications from us. You can unsubscribe from email newsletters or similar communications by clicking on the unsubscribe link in every email and you may opt out of text messages by replying STOP to any marketing messages you receive from us. You may opt-out of all Personal Information sharing with third parties for marketing purposes by emailing us at info@campbowwowusa.com or by sending a letter to us at the address below. If you wish to opt-out of communications from a specific camp location, please contact that location/Franchisee directly via the email links or other contact information on that location’s specific Site. Please note that we do not currently have a centralized opt-out mechanism applicable to all of our Franchisees and our various businesses, services and locations, so you will need to contact specific Franchisees directly.

To obtain a list of the Personal Information that Camp Bow Wow holds about you, or for residents of California and Canada (as required by California and Canadian law) to receive a list of the names and addresses of all third parties that received your Personal Information from Camp Bow Wow for direct marketing purposes during the preceding calendar year, and other purposes as required, please send a written request for this information, including your name, address, email address and phone number, with your signature, to us at the address below.

You have the ability to control the amount of Personal Information you provide to us and therefore you may restrict our use and disclosure of your Personal Information by not providing the Personal Information to us in the first place. However, if you choose to limit the Personal Information you provide, it may limit the manner in which you can use our services and to otherwise interact with us.

WHAT SECURITY PRECAUTIONS ARE IN PLACE TO PROTECT AGAINST THE LOSS, MISUSE, OR ALTERATION OF YOUR INFORMATION?

We have implemented reasonable security measures to safeguard the Personal Information you provide us. However, please keep in mind that “perfect security” does not exist on the Internet, and accordingly we cannot provide any guarantee that your information will remain secure.

LINKS TO OTHER WEBSITES.

You should be aware that when you use a Digital Service you could be directed to other sites beyond our control. For example, if you click on certain links, you will likely leave the Site or App and move to a different site which is not operated by us. These other services may send their own cookies to you, independently collect data or solicit Personal Information and may or may not have their own published privacy policies. If you visit a site that is linked to by a Digital Service, you should carefully review that site’s privacy policy before providing any Personal Information. This Privacy Policy does not apply to any information you submit to third-party sites, except it may apply to information provided to Franchisees as described herein.

INTERNATIONAL USERS.

If you are accessing our Digital Services from outside of the United States, when you provide Personal Information to us, you acknowledge that your Personal Information will be transferred to us, the Franchisees, or our service providers in the United States, and you consent to such transfer, as well as the use and processing of your Personal Information in accordance with this Privacy Policy. Regardless of where your Information is collected or transferred, if it is provided through the Digital Services, it will be treated in accordance with this Privacy Policy.

LIMITATION OF LIABILITY.

By providing us with any Personal Information you expressly and unconditionally release and agree to hold harmless Camp Bow Wow, the Franchisees, and its or their parents, subsidiaries, affiliates, related companies and their respective shareholders, owners, members, directors, officers, employees and agents (collectively, the “Releasees”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected Personal Information. In addition, while we take reasonable steps to prevent third party companies from making unauthorized use of your Personal Information, we cannot be held be held liable for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse thereof by those third parties.

NOTIFICATION OF CHANGES AND ACCEPTANCE OF THE PRIVACY POLICY.

By using any of our Digital Services, you signify your agreement to the terms of our Privacy Policy. We may change this Privacy Policy from time to time. If so, any such changes will be posted on this page, so that the we may keep users informed of our privacy practices. Accordingly, we recommend that you consult this page frequently so that you are aware of our latest policy. Your continued use of the Digital Services shall constitute your acceptance of such revised Privacy Policy.

The first sentence of this Privacy Policy indicates when the Privacy Policy was last amended.

This Supplemental Privacy Policy and Notice ( “Supplemental Policy”) supplements the information contained in CBW’s primary Privacy Policy and applies only to information collected about consumers residing in California, Colorado, Virginia, Utah, or Connecticut (“Consumer(s)”). It provides information required under the California Consumer Privacy Act of 2018 and as amended by the California Privacy Rights Act of 2020 (collectively, the “CPRA”), the Colorado Privacy Act of 2021 (the “CPA”), the Virginia Consumer Data Protection Act of 2021 (the “VCDPA”), the Utah Consumer Privacy Act of 2022 (the “UCPA”), and the Connecticut Data Privacy Act of 2022 (“CDPA”) and any and all regulations arising therefrom.

This Supplemental Policy describes the practices of CBW (“we,” “us,” or “our”) regarding the collection, use, and disclosure of personal information and provides instructions for submitting data subject requests. Some portions of this Supplemental Policy apply only to consumers of particular states, and we have indicated where those portions are state-specific.

Definitions Specific to this Policy

  • Consumer” means a natural person who resides in California, Colorado, Virginia, Utah and Connecticut and to whom we offer information, goods, or services. For purposes of this Supplemental Policy, this term includes natural persons who reside in California and engage with us as part of business-to-business transactions.
  • Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or household. Personal Information includes “personal data” as that term is defined in the CPA, VCDPA, UCPA, and CDPA. Personal Information also includes “Sensitive Personal Information,” as defined below.
  • Sensitive Personal Information” means Personal Information that reveals a Consumer’s: 1) Social security, driver’s license, state identification card, or passport number; 2) Account log-in, financial account number, debit card number, or credit card number in combination with any required security or access code, password, or credentials allowing access to the individual’s account; 3) Precise geolocation; 4) Racial or ethnic origin; 5) Religious beliefs; 6) Union membership; 7) Contents of email or text messages, unless we are the intended recipient; 8) Genetic data; 9) Biometric information used to uniquely identify the Consumer, and 10) Health, sex life, or sexual orientation. Sensitive Personal Information includes “sensitive data” as that term is defined in the CPA, VCDPA, UCPA, and CDPA.
  • “Sell,” “Sale,” or “Sold” means renting, releasing, or transferring an individual’s Personal Information to a Third Party for money or other valuable consideration.
  • Share,” “Shared,” or “Sharing” means transferring an individual’s Personal Information to a Third Party for behavioral advertising purposes, whether or not for money or other valuable consideration.
  • Third Party” means a person or organization which is not a Consumer, Vendor, or an entity owned or controlled by us and as defined by the CCPA, CPA, VCDPA, UCPA, and CDPA.
  • Vendor” means a “service provider,” “contractor,” or “processor” which collects, stores, or otherwise handles data for us, as those terms are defined in the CCPA, CPA, VCDPA, UCPA, and CDPA.

These definitions apply, whether terms are capitalized or not. Other terms used in this Supplemental Policy may be defined under the CCPA, CPA, VCDPA, UCPA, or CDPA, and they shall have the meanings described in those statutes. If there are variations between such definitions in different laws, you will be covered by the definition that applies in your state. For example, if you are a Virginia consumer, terms defined in the VCDPA shall apply to you if they are used in this Supplemental Policy.

These definitions apply, whether terms are capitalized or not. Other terms used in this Supplemental Policy may be defined under the CCPA, CPA, VCDPA, UCPA, or CDPA, and they shall have the meanings described in those statutes. If there are variations between such definitions in different laws, you will be covered by the definition that applies in your state. Retention of Data

We intend to retain each category of personal information described above only for as long as necessary to fulfill the purpose for which it was collected, or a related and compatible purpose consistent with the average consumer’s expectation, and to comply with applicable laws and regulations. Your Rights to your Personal Information

California, Colorado, Virginia, Utah, and Connecticut consumers have certain rights with respect to the collection and use of their personal information. Those rights vary by state. As required by the CCPA, we provide detailed information below regarding the data subject rights available to California consumers. You have the right to submit requests related to the personal information we have collected about you. You may make such a request twice in a 12-month span. Please note, there are circumstances when we may not be able to comply with your request. For example, we may not be able to verify your request or we may find that providing a full response conflicts with other legal obligations or regulatory requirements. Right Know and Right to Access. You have the right to request certain information we have collected about you. You have the right to request:

  • The categories of personal information we shared, sold or disclosed; and

We do not sell or share personal information or process personal information for targeted advertising purposes. We also do not knowingly sell or share personal information of consumers under 16 years of age.

Do Not Sell or Share My Personal Information

If you opt-out of the sale of your personal information, we will wait at least 12 months before asking you if we may sell or share your personal information.

You have the right to opt-in to the sale of your personal information after you have opted out. Opting-in is a two-step process in which you will first clearly request to opt-in, and then separately confirm that choice.

Right to Consent to or Limit the Use of Your Sensitive Personal Information. You have the right to consent to the use of your Sensitive Personal information in CO, CT, VA and UT. Separately, you have the right in CA to instruct us to limit the use and disclosure of your Sensitive Personal Information to only that which is necessary to perform the services or provide the goods reasonably expected by an average consumer or for specific business purposes defined by law.

We do not use Sensitive Personal Information for purposes beyond those authorized by the CCPA, or beyond your consent.

Right to Non-discrimination. You have a right to exercise the above rights, and we will not discriminate against you for exercising these rights. Please note that a legitimate denial of a request to access, delete, or opt-out is not discriminatory, nor is charging a fee for excessive or repetitive requests.

If you use the telephone number, you will be guided through a process that will allow you to submit a verifiable request, and the level of verification will depend on the request being submitted. You may designate an authorized agent to exercise your rights under the CCPA on your behalf. Such individual must have power of attorney, or be an authorized agent registered with the relevant Secretary of State.

Right to Appeal [for California, Virginia, Colorado, and Connecticut Consumers]. You have the right to appeal our decisions about your data subject requests. If you choose to appeal, your request will move from Customer Support to our Legal Department for review. Verification Process

When you submit a request to exercise your data subject rights, we may ask you to provide information that will enable us to verify your identity.

If you designate an authorized agent to exercise your rights on your behalf, we may require that you or the authorized agent do the following:

  • Verify your identity with us directly.
  • Provide proof of your signed written permission for the authorized agent to submit a request on your behalf.

We may deny a request from an agent purportedly acting on your behalf if we request, and the agent does not submit, proof that he, she, or it has been authorized by you to act on your behalf.

Personal Information of Minors

Our online content is not intended for children or minors under the age of sixteen years. Accordingly, we do not knowingly store information from minors under the age of sixteen years, except as required by applicable law.
